Mediation and arbitration have become increasingly popular alternatives to litigating a case before a judge and/or jury.  In mediation, the parties select a neutral third party who has been trained to work with the parties to facilitate a final and binding agreement.  The mediator does not give legal advice and does not force the parties to reach an agreement.  The parties choose their own agreement through a negotiation process that is facilitated by the neutal mediator. More than ADR can help you to select an experienced neutral to serve as the mediator for your dispute. The mediation process is most successful when parties devote an uninterrupted space of time to the process and arrive at the mediation with all key decision-makers, as well as any materials they may need to refer to during the course of the mediation.
